Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Dealviora AI: Design & Shop mobile application, website pages, APIs, and related services (collectively, the “Service” or “App”), operated by the Dealviora AI: Design & Shop developer team (“we”, “us”, or “our”).

By creating an account, purchasing a subscription or credits, uploading content, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

AI-generated results disclaimer. Room images and product placements produced by the Service are created by artificial intelligence for inspiration and visualization only. Results may differ each time you generate, may contain visual errors or unrealistic elements, and are not professional design, architectural, engineering, or safety advice. Always verify colors, dimensions, products, prices, and suitability before making purchase or renovation decisions.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian. The Service is not intended for children below the applicable minimum age.

2. The Service

Dealviora AI: Design & Shop helps you upload room photos and receive AI-assisted décor previews (for example Decorate, Fill Space, Paint, and Redesign modes), browse suggested products, manage credits and subscriptions, and save designs.

We may add, change, suspend, or remove features at any time. We do not guarantee uninterrupted availability, specific processing times, or particular output quality.

3. AI-generated content

You understand and agree that:

Outputs are automatically generated and may vary between sessions, even with the same inputs.
Outputs may include glitches, artifacts, distortions, incorrect proportions, or missing/extra objects.
Colors, materials, lighting, furniture placement, and product appearance in generated images are approximate and may not match real-world products or paint.
Suggested products are recommendations; we do not guarantee that a product will fit your space, match the generated image exactly, or remain available at a shown price.
The Service is not a substitute for licensed interior designers, architects, contractors, electricians, plumbers, or other professionals.
You are solely responsible for decisions you make based on generated content, including purchases, renovations, and structural changes.

4. Your content and conduct

4.1 Photos and uploads

You retain ownership of photos and other content you upload. You grant us a limited license to host, process, transmit, display, and store that content solely to operate the Service (including sending images to AI and storage providers as described in our Privacy Policy).

You represent that you:

Own or have the necessary rights and permissions to upload and use your content;
Will not upload unlawful, infringing, harassing, or sexually explicit content;
Will not upload images of people without their consent where required by law.

4.2 Acceptable use

You agree not to:

Reverse engineer, scrape, or abuse the Service or its APIs;
Attempt to bypass credits, subscriptions, rate limits, or security controls;
Use the Service for fraudulent, harmful, or illegal purposes;
Resell or commercially exploit generated outputs in a way that misrepresents them as guaranteed professional work without appropriate disclaimers.

We may suspend or terminate accounts that violate these Terms.

5. Credits, subscriptions, and purchases

5.1 Credits

Design generations consume credits according to in-app pricing (for example, a standard generation or redesign may cost multiple credits).
Credits have no cash value, are non-transferable, and may expire or change as we update the Service.
Free credits, ad-reward credits, and promotional credits may be subject to limits described in the App.

5.2 Subscriptions and credit packs

Paid plans and credit packs are processed through Google Play and/or the Apple App Store.
Subscriptions renew automatically unless cancelled through your store account before the renewal date.
Prices, billing periods, and included credits are shown in the App at the time of purchase and may vary by country.
Refunds for store purchases are handled under the applicable store’s refund policies unless otherwise required by law.

5.3 Failed generations and refunds

If a generation job fails due to a technical error on our side, we may refund the credits used for that job according to our internal policies. Queue unavailability, user cancellation of in-progress jobs, or dissatisfaction with AI output quality (when the Service functioned as designed) do not automatically entitle you to a refund unless required by applicable law or store policy.

6. Affiliate and third-party products

The Service may display links or suggestions for third-party products (for example, marketplace listings). We may earn affiliate commissions when you purchase through those links.

We do not sell those products directly;
Prices, availability, shipping, returns, and warranties are controlled by third-party sellers;
Any purchase is solely between you and the seller;
We are not responsible for third-party products, services, or websites.

7. Intellectual property

The App, branding, software, and underlying technology are owned by us or our licensors and protected by intellectual property laws. These Terms do not grant you ownership of our software or trademarks.

Subject to these Terms and applicable law, you may use AI-generated images from your own account for personal, non-commercial purposes. Commercial use may require separate rights depending on third-party content, trademarks visible in photos, and applicable law.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT GENERATED IMAGES WILL BE ERROR-FREE, REALISTIC, SAFE TO IMPLEMENT, OR SUITABLE FOR ANY PARTICULAR PURPOSE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED INDIAN RUPEES (₹100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.

10. Indemnification

You agree to defend, indemnify, and hold us harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Account termination

You may stop using the Service at any time and may delete your account as described in our Privacy Policy. We may suspend or terminate access if you breach these Terms or if we reasonably believe your use poses risk to the Service, other users, or third parties.

12. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top will change when we do. Material changes may also be communicated in the App or via store listing updates. Continued use after changes become effective means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country require otherwise.

You agree that courts located in India will have exclusive jurisdiction over disputes arising from these Terms or the Service, unless applicable law requires a different forum.
